Release blocker: counsel must approve and insert the operator’s verified legal details, governing law, court or dispute forum, consumer terms, and refund language before publication. This notice prevents release; it is not a substitute for those terms.

1. What This Document Is About

These terms govern the use of the Clam mobile app and the clam.mom website (the “Service”). By installing the app or using the website, you agree to these terms and the privacy policy. If you do not agree — please do not use the Service.

2. The Most Important Thing: Clam Is Not a Doctor

Clam is an informational assistant. It is not a medical device, does not diagnose, and does not prescribe or discontinue treatment. The materials of the Service — including texts generated by the AI features (lab result explanations, summaries, AI chat responses) — are for reference purposes and do not replace consultation with a doctor. Document recognition and AI texts may contain errors — check the values against the original. If you experience alarming symptoms, contact a clinician. In an emergency, call your local emergency number.

Decisions about your health and your child’s health are made by you together with your treating physician. The operator is not liable for the consequences of decisions made solely on the basis of information from the Service.

3. Account

Some features (for example, the “Lab Results” section) require an account. You undertake to provide a valid e-mail and not to share access with third parties.
You are responsible for keeping your password secure and for the actions taken in your account.
The Service is intended for users aged 18 or older.
You can delete your account at any time — see the instructions.

4. Free Features and the Clam+ Subscription

Clam’s core features are free.
AI features (lab result explanations, appointment preparation, AI chat) work after separate consent and have free limits (for example, the number of explanations per month and chat messages per day); the limits are displayed in the app and may change. The Clam+ subscription increases the limits.
Extended features will be available with the Clam+ subscription (once it launches). Prices, the free trial, and the terms are displayed in the app store before you subscribe.
Subscription payment and renewal are processed by the app store (Google Play, App Store) under its rules; the subscription is also cancelled there. Cancellation does not refund the payment for a period that has already begun, unless the store’s rules provide otherwise.
We may change the set of Clam+ features without materially degrading a period you have already paid for.

5. Acceptable Use

It is prohibited to: hack, overload, or disrupt the operation of the Service; upload other people’s documents without a lawful basis; use the Service to cause harm; copy and distribute the Service’s content for commercial purposes without permission.

6. Your Data and Content

By uploading documents, you confirm that you have the right to have them processed (for example, they are your own lab results or your child’s lab results). You retain the rights to the documents you upload; we process them only to operate the features of the Service — see the privacy policy for details.

7. Intellectual Property

The app, the website, the texts, the design, the Clam logo and name belong to the operator. Using the Service does not transfer to you any rights in them, other than the right to use the Service as intended.

8. Disclaimer of Warranties and Limitation of Liability

The Service is provided “as is”. We strive to keep Clam stable and accurate, but we do not guarantee the absence of errors or interruptions, or the completeness of information. To the maximum extent permitted by law, the operator’s liability is limited to the amount you paid for the subscription over the last 12 months (for free use, no monetary liability arises) and does not extend to indirect damages.

Nothing in these terms limits rights that cannot be limited under applicable consumer protection law.

9. Termination of Access

We may suspend or terminate access to your account in the event of a material breach of these terms, giving you notice where possible. You may stop using the Service at any time by deleting your account and the app.

10. Changes to These Terms

We may update these terms. We will notify you of material changes in the app and update the version date. Continued use after the changes take effect constitutes acceptance of the new version.

11. Governing Law and Disputes

The operator’s jurisdiction, the governing law, and the forum for disputes are being finalised and will be published in this clause. Nothing here affects the mandatory consumer rights and deadlines available to you where you live. You may contact support@clam.mom at any time without waiving any statutory right or deadline.
